Return Request and Misleading Practices
Dear Velora-Amsterdam Team,
This is a formal and final request for a prepaid return label for the defective and misrepresented product I received.
The item you sent is substandard and not as advertised, falling apart straight out of the packaging. This constitutes a breach of the Warenwet (Dutch Commodities Act) and Book 6 of the Dutch Civil Code (BW), specifically Article 6:193b BW, which prohibits misleading commercial practices, including misrepresentation of product origin and quality.
Furthermore, your branding as "Velora-Amsterdam" — while shipping from China and failing to disclose this prior to purchase — is a deliberate attempt to deceive consumers, and is likely in violation of EU Directive 2005/29/EC on Unfair Commercial Practices, as implemented in Dutch law. It misleads on the geographic origin of the business and products, which significantly affects consumer decision-making.
Your so-called “30 Days Worry-Free Returns” policy is also misleading under Article 6:230m BW, which requires that all terms regarding returns — including who bears the cost — must be stated clearly, unambiguously, and prior to conclusion of the contract. Failing to disclose that return shipping is at the consumer’s expense while advertising “worry-free” returns is not only unethical, it is unlawful.
Additionally, I remind you that under Article 7:17 BW, consumers are entitled to products that meet the expectations raised by advertisements and the nature of the item. Your product does not.
Let me be absolutely clear:
- I am demanding a full refund and a prepaid return label.
- You have 7 days to comply with this request.
- Failure to do so will result in an official complaint to the Dutch Authority for Consumers and Markets (Autoriteit Consument & Markt, ACM) as well as a chargeback claim through my payment provider, citing misleading business practices and failure to comply with EU consumer law.
This is your final opportunity to resolve the matter amicably and legally.
