Morning Yvonne,
Just having a look at Hesterval, Freswick, KW1 4XX again and it looks like every window in the rooms of the bungalow only have top openers and do not comply with current building regulations, they should have the bottom have of the window as an opening window with a min opening width of 450 mm and a min height opening of the same 450mm as a safe way to exit the building in case of a fire...THIS WAS A LEGITIMATE CONCERN FOR ME).....( The reply from Yvonne). We are selling the property as it is. It does not matter what you think it should be. If you have any further concerns about the report then take them up with the surveyor that carried it out.
You can find their number on the home report. Our job is to sell the property, not deal with building control issues that are not relevant to the sale.

AS I THOUGHT THAT Estate agents must provide buyers with all relevant details about a property and have some duty of care.. Concealing information, be it intentionally or accidentally, breaches the agent's duty.
One other point in question about the property "Hesterval" May I point out that there is no phone line in the property and Openreach have no plans to install lines in that area anytime in the near future also it lies in a very bad area for broadband with NO signal, so please make any prospective buyers aware off that...........and as far as being interested in the property with your attitude being as it is I am no longer interested (TW)

Don't put yourself down,
You are just as qualified to answer any questions on the matter that I raised as Yvonne.
It's basically common sense
No formal qualifications are legally required to be an estate agent in the UK.
Nor do you have to have any qualifications to be a property investor, just the ability to buy at the right price with the goal of earning money from it, often through rental income or by selling the property for a profit. I am also a property investor having bought and sold many properties in England, Wales and the Isle of Man throughout my life, I try not to have more than one property at a time that way avoiding extra taxes that are normally payable.
It's just that I like to keep up to date with building regs and expect estate agents to do the same.....................................................................

Hello Tom,
I am a property developer and am well aware of building legislation. If you were to replace or do work structurally to a property, building control would need to be informed. Not for a window change, only if it was a listed building. Any new replacement windows would obviously meet today’s standard. We sell hundreds of properties with windows prior to 2003. However, in the property you are enquiring about they do not need to be informed as it has the original windows.
The house is being sold in its present state so therefore building control do not need to be informed. Furthermore, solicitors ask people if anything structural has been done prior to any sale going through. If there has been work done the owners would need to disclose it and provide warrants. The only thing they would need a warrant for is if they removed a window and replaced it with patio doors. A conservatory does not need planning permission although it needs a building warrant. Removing a non-structural wall does not need a warrant either.

If you have any further questions regarding the property and are interested, I would suggest you speak to your solicitor.

If you were in bedroom 3 in that property or even in bedroom 2 and a fire broke out in the lounge and spread into the hallway then you would struggle to get out
That is why windows should be up to building standards.
Building control have told me that if bedroom windows were to be replaced today then they should be a bottom opener that opens at least to 450mm...........
