Dutch branding, Chinese product, no labels — and no real returns

I ordered a jacket from Thirty-eight (order #10442, €79,99). The package arrived from China with Chinese markings — despite the website presenting itself as a Dutch brand with a Dutch address and a "30 dagen geld-terug-garantie."
The jacket itself had no labels of any kind: no brand, no fiber composition, no care instructions, no size label. This is illegal under EU textile regulations.
When I requested a return, I was told the only address on file explicitly states "GEEN Retouradres." The seller offered 10% cashback or 50% store credit — not a real refund, and not what their advertised guarantee promises.
What the website doesn't tell you: the company behind "Thirty-eight" is actually GOLO Commerce Group (KVK 94175608), which appears to operate multiple storefronts under different Dutch-sounding brand names.
I have filed formal complaints with both the ACM (misleading trading practices) and the NVWA (missing textile labeling). I'd encourage other affected customers to do the same.

Thirty-Eight site UNTRUSTWORTHY

My most terrible experience on internet!!
Shameless and untrustworthy people. My sweater was too snall, had no mark and no specifications attached. Probably used before.
They offered me to keep it and get 10% back .
Or send the sweater at own costs (€74) back to China and wait for Santa Claus from China!!

Very very bad communication yells you…

Very very bad communication tells you your order is Deliverd which is not then you need to track the lost parcel yourself and giving new wrong or fake tracking Numbers. Don’t respond when you ask your money back . Over a month now that i orderd something and they don’t help you just give vage answers.

Absolutely terrible site

Absolutely terrible site, do not do business with them. They are cheats and thieves. The shop pretends to be based in the Netherlands, whereas it is Chinese. They send you poor quality items at high prices and then want to charge high prices for return to China.
Nowhere on the site does it say that they are based in China.

This company is a scam

This company is a scam, they will deliver wrong and unwearable product and then ignore you for weeks when you ask for refund and return instructions. Do not ever order from there, unless you want to throw your money into garbage.

No return label, bad quality clothing

The item I recieved didn't even look like the photo, colour and texture was different. 'Olivia' denied my request for a return label. You pay for transport and delivery costs, the item's worth is only a small part of the price you pay. Dropshipping from China. Shein but more expensive. Do not shop here.

I received stainless steel cutting…

I received stainless steel cutting boards. Not knowing where they came from I placed them on top of the refrigerator. About a week later I emailed the company about my family canvas I ordered. A lady named Olivia said my package was delivered and attached a photo of the delivery. I explained that delivery were cutting boards. She asked for a photo and did I stlii have the packaging. I sent a photo
unfortunately I threw the packaging away. No response I reached back out via email Olivia claimed she didn't receive the photo. I sent it two more times before she responded. Olivia said she will work on finding out what happened. Have not heard from her or anyone else from this company. That was 30 days ago. I also look for a phone number to speak with someone. There is not a phone number just the email address.

Extremely disappointing, unlawful experience – Avoid at all costs

I had a very bad experience with this online shop, and I feel obligated to warn other consumers before they make the same mistake.

I submitted a return request on the same day I received the item, well within the legal 14-day reflection period as defined under EU and Dutch consumer protection law (see: business.gov.nl – reflection period). According to the law, consumers have the right to cancel their purchase within 14 days from the date they received the product, without needing to provide a reason or pay any additional costs.

Despite this clear legal framework, the person named Olivia from customer service deliberately stalled my request. Over the course of an entire month, she sent a string of irrelevant, evasive emails—filled with insincere language and empty reassurances—while never answering my simple question about where to send the return. I asked for the return address six separate times, and she ignored the question every single time.

Finally, after one month of dodging, she had the audacity to claim that my return period had expired. In other words, she purposely delayed the process long enough to then blame me for a "late" return. This is a textbook example of manipulative tactics and bad faith customer service, and in my opinion, it borders on fraud.

This shop is clearly not compliant with EU/NL consumer law, including:

Directive (EU) 2019/2161 – Article 4b

Directive 2011/83/EU – Articles 9, 10, 13, 14 and Annex 1

Regulation (EU) 2022/1925 – Article 34

Dutch Civil Code Book 6: Articles 230h, 230t, 230v, 230o, and Section 3

Their handling of this return request violates not only your consumer rights, but also basic principles of fair business conduct. I highly encourage others to read the reviews, which reveal a pattern of similar behaviour from this company.

DO NOT SHOP HERE.
Unless you are prepared to be misled, ignored, and denied your legal rights, stay far away from this retailer. I will be monitoring this company closely and will not hesitate to take further action should they continue their deceptive practices.

Don't buy anything!!

I ordered shoes and after 3 weeks the shoes are already broken. They do not at service and only give a maximum of 30% back. It is really a very bad company, do not buy anything here!

Don't buy anything here!!

Received a broken dress. Thirty Eight does not want to arrange anything for this and holds me as the buyer responsible for the return costs while they delivered a broken dress. Please do not buy anything here. The goods also appear to come from China. Ridiculous!!!

Total scam! Do not buy!
Item is total rip off from the advertisement and smells like plastic. You need to return the item at your own costs (€25!) to China. I never received a refund. Absolute fraude.
