Händler erfüllt Gewährleistungspflicht…

Händler erfüllt Gewährleistungspflicht nicht

Mein Mobiltelefon war nach 18 Monaten Gebrauch defekt. Der Hersteller untersuchte es samt Innenleben und stellte fest, dass der Schaden nicht durch unsachgemäße Behandlung entstanden und somit von der Händlergewährleistung abgedeckt war.
Die HM Trade GmbH reagierte erst zwei Monate nach Einschalten eines Anwalts. Das Gerät wurde schließlich an den Händler geschickt, welcher das Telefon nach vier Wochen unrepariert zurücksandte mit der Behauptung, es sei kein Defekt nachweisbar, nur ein Softwareupdate nötig.
