Subject: Formal Complaint – Unlawful Cancellation of Binding Booking / Request for Legal Justification and Escalation
Dear Sir or Madam,
I hereby submit a formal complaint regarding the handling of the booking associated with my apartment and your repeated refusal to provide a legally substantiated justification for its cancellation.
Despite multiple communications, your responses remain inconsistent, legally flawed, and fail to address the core issues raised.
1. Incorrect reliance on § 550 BGB
Your argument that the booking was not legally binding due to § 550 BGB is incorrect.
§ 550 BGB applies only to fixed-term rental agreements exceeding one year.
The agreement in question had a duration of exactly 12 months, not exceeding one year.
Even if § 550 BGB were applicable, the legal consequence would not be invalidity of the contract, but merely that the agreement is deemed indefinite and ordinarily terminable.
Your conclusion that “no legally effective contract existed” is therefore legally unfounded.
2. Binding nature of the booking under your own Terms & Conditions
According to your own Terms & Conditions (§ 13 “Booking Process”):
“The mere booking confirmation constitutes a fully binding contract between the parties.”
This means:
A binding contract was concluded between myself and the tenant
You act solely as an intermediary, not as a contractual party
You have no legal authority to unilaterally cancel or terminate this contract
Your own Help Center further confirms:
“Once a booking is confirmed, it is legally binding for both parties. A cancellation must always be mutually agreed.”
Your actions directly contradict both your AGB and your published policies.
3. Unlawful interference in contractual relationship
By cancelling the booking unilaterally:
You have interfered with an existing contractual relationship between two parties
You have deprived me of the opportunity to enforce contractual claims against the tenant
You have caused a measurable financial loss of approximately €2,000
To date, you have failed to provide:
any specific legal basis for your intervention
any contractual clause authorizing your actions
Generic references to “internal policies” are not sufficient.
4. Failure of escalation and refusal of cooperation
Furthermore:
My repeated requests to escalate this matter to your complaints management have been ignored or refused
I have not received a transparent or legally reasoned response
My request for tenant data necessary to pursue legitimate claims has been disregarded
This lack of cooperation is unacceptable, particularly given your role as intermediary in a binding transaction.
5. Formal demands
I hereby formally request:
A clear and specific legal basis (statutory and/or contractual) justifying your unilateral cancellation
Identification of the exact clause in your AGB authorizing such action
A statement on how you intend to remedy the financial damage incurred (€2,000)
Confirmation whether and under what conditions you will provide the necessary tenant data for legal enforcement
6. Reservation of rights
Should you fail to provide a substantiated response, I expressly reserve the right to:
pursue legal action to recover damages
formally challenge your conduct under applicable civil law
escalate the matter to relevant regulatory and consumer protection bodies
I expect a comprehensive and legally substantiated response within 7 days.

I had a great experience with wunderflats. Of course especially when you book last minute everything is kind of stressful but I had a very direct and good communication with Jana which was really helpful!

I worked with Eldar Halak on a few questions ahead of booking a flat. Eldar was responsive and was able to address all of my questions, helping me feel at ease with the renting process. I look forward to my stay!

They refused to return my deposit and justified it by claiming their landlords aren't engaged in commercial activity — therefore consumer protection law supposedly doesn't apply to them.
During negotiations, they tried to threaten me about legal action and additional costs.
On top of that: the actual cost of renting through this platform can be ~20% higher than advertised. Hidden fees appear only after booking.
No signed contract existed at the time of the dispute. No legal basis for withholding the deposit. Just opacity, manufactured legal arguments, and intimidation when you push back. Stay away.
