So this guy has been on EBay for 14…
Without malice or prejudice
So this guy has been on EBay for 14 years and should by now know all the eBay rules yet he sent me this.
"Hi, We have noticed you used our own images to list your replacement parts here on eBay. It will be nice we maintain a healthy eBay environment. It wldnt be nice if we start escalating to eBay to remove listings of other sellers because of image infringement. Kindly do the needful. Regards"
You can quite clearly see here that he is threatening me to either remove the image or he will contact ebay to remove my listing....
however in the ebay user terms it quite clearly states that any image uploaded by a seller can be used by ebay and any other seller within their listings....
this is ebays words!
What should I do if my image, video or text is being used by another seller?
When you create listings you give eBay and its customers permission, through our User Agreement, to use your images, videos and product details. Your content may be added to the eBay product catalogue, and may be used by other sellers in their eBay listings.
this seems strange because this person has been an ebay seller for 14 years and should be in full knowledge of this rule!
This just shows how unprofessional this company might be
To threaten somebody else knowing the rule that exists which allows me to utilise this or any other image from any eBay member as outlined in their user policy..is very strange indeed.
He also lists himself as an international company on his listings yet looking at his company house formation and financial figures show a balance sheet for 2023 of 2k yes 2k..., which in effect was a 7k loss from the previous year. as these are public documents it is quite legal to post them or reference them in any communication and nowhere does it list his company on companies house as any form of international, supplier, buyer or distributor.
Therefore, I would assume that he is not an international company and he may be fabricating the truth to make himself look good in purchaser’s eyes...
This is not very professional is it..
In addition, as he should after 14 years of being on eBay be fully aware of these rules yet he persisted to threaten and try to bully me!
To summarise would you use a company like this that portrays themselves to be something other than what they actually are, which makes me wonder what else is being fabricated.
To send me a message without doing any DUE DILIGENCE, prompts me to think that he may be in breach of his Fiduciary duty as a company director.
